How to request a disability accommodation at work

On Behalf of | Jun 1, 2023 | Employment Discrimination

Requesting a disability accommodation at work is an important step towards ensuring equal opportunities and a supportive work environment if you have a disabling condition that makes certain aspects of your work experience more difficult than they need to be.

Employers are legally required to provide reasonable accommodations to disabled workers, as long as a request will not cause their business undue hardship. With that said, the way in which you approach the request process can go a long way toward securing approval, especially if your employer is notoriously difficult to deal with.

Steps to take as you move forward

Here are some guidelines to consider when making such a request:

  1. Understand Your Rights: Familiarize yourself with your rights under disability discrimination laws, including the Americans with Disabilities Act (ADA). Know the definition of disability and the legal obligations of your employer to provide reasonable accommodations.
  2. Gather Relevant Information: Educate yourself about your specific disability or condition, including its impact on your ability to perform essential job functions. Identify potential accommodations that could address your needs and enable you to perform your job more effectively.
  3. Consult Healthcare Professionals: Seek input from healthcare professionals familiar with your condition. They can provide documentation that supports your accommodation request and outlines the specific limitations and recommended accommodations.
  4. Communicate with Your Supervisor or HR: Initiate a conversation with your immediate supervisor or the Human Resources department. Clearly explain your disability, how it affects your work and the accommodations you are requesting. Provide any necessary medical documentation to support your request.
  5. Follow Company Procedures: Familiarize yourself with your company’s policies and procedures for requesting accommodations. Adhere to any specific protocols or forms required for submitting your request. Maintain copies of all documentation and correspondence related to your accommodation request.
  6. Engage in an Interactive Process: Be open to engaging in an interactive process with your employer. This involves discussing potential accommodation options, exploring alternatives and finding mutually agreeable solutions.
  7. Document Everything: Keep records of all interactions, including emails, meetings and discussions, related to your accommodation request. This documentation can serve as evidence of your efforts to request accommodation and any responses or decisions made by your employer.

The accommodation process should be a collaborative effort between you and your employer. Be proactive, clear and open in your communication. If your request is denied or you face any challenges, you can seek legal guidance at any time.
